Terms of Service

Cortex is a self-serve audit tool for DTC brands using Klaviyo. After you authorize read-only access to your Klaviyo account, Cortex analyzes your email and SMS flow coverage, calculates pass-through rates, and produces revenue projections based on benchmarks from over 100 brands.

You must be at least 18 years old and authorized to act on behalf of any Klaviyo account you connect. By connecting a Klaviyo account, you represent that you have the right to grant Cortex access to that data.

• Sign-in is via Google Sign-In (OAuth) or a magic link sent to your email — there are no passwords for user accounts. You may optionally add a phone number to your account; if you do, a sign-in link can also be delivered to that number by SMS.
• Google Sign-In is subject to Google's own Terms of Service and Privacy Policy. By signing in with Google, you authorize Cortex to receive your name, email address, and profile image.
• If you provide a phone number, Cortex uses SMS only for transactional sign-in messages — magic links sent in response to a sign-in request you initiate. We do not send marketing or promotional SMS. Standard message and data rates may apply. Reply STOP at any time to stop receiving messages.
• You are responsible for maintaining access to the email address (and phone number, if provided) associated with your account.

You agree not to:

• Use Cortex to access a Klaviyo account you don't own or have permission to access.
• Attempt to scrape, reverse-engineer, or interfere with the service, infrastructure, or other users.
• Resell, sublicense, or republish audit reports as your own product.
• Use the service for any unlawful purpose.

• You own your data. The Klaviyo data you connect, and any inputs you provide, remain yours. We process it on your behalf to produce the audit. See our Privacy Policy for details on storage and sharing.
• We own the platform.Cortex's code, design, audit methodology, benchmarks, and underlying intellectual property belong to 11 Agency. These terms grant you a non-exclusive, non-transferable license to use the service for your own business purposes.
• Audit reports. You may share your own audit reports internally or with consultants, but you may not redistribute them as part of a competing product.

Audit results — including flow coverage, pass-through estimates, and revenue projections — are estimates based on benchmarks from over 100 DTC brands and the data available through Klaviyo's API. They are intended as directional guidance, not guarantees of future performance. Actual results depend on factors outside the scope of the audit, including creative quality, brand fit, list health, and market conditions.

Cortex is provided on a best-effort basis. We do not guarantee uninterrupted availability and may modify, suspend, or discontinue features at any time. We will give reasonable advance notice of material changes when possible.

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that audit results will produce any specific business outcome.

To the maximum extent permitted by law, 11 Agency and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of revenue, profits, or data, arising from your use of the service. Our total aggregate liability under these terms will not exceed the greater of (a) the amount you paid us for the service in the twelve months prior to the claim, or (b) one hundred US dollars ($100).

You may stop using Cortex and disconnect Klaviyo at any time from the gear menu in the app. To delete your account entirely, email raymond@11.agency.

We may suspend or terminate accounts that violate these terms, abuse the service, or create risk for us or other users.

We may update these terms as the product evolves. Material changes will be communicated by email or in-app notice. Continued use of the service after a change takes effect constitutes acceptance of the new terms.

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in California, and you consent to the jurisdiction of those courts.
